Terms and conditions
1.Area of application
These general terms and conditions set forth the relations between the Gewandhaus zu Leipzig and its customers. They shall be a component of the agreement on purchasing admission tickets.
Customers shall be:
I. Persons who attend and/or have the intention of attending the Gewandhaus zu Leipzig, in particular persons who purchase and/or have the intention of purchasing admission tickets for events at the Gewandhaus zu Leipzig or for joint events at the Gewandhaus zu Leipzig with partners, and
II. Interested persons and purchasers of admission tickets whose business establishment or articles of association provide for resale or the mediation of admission tickets. Said interested persons and purchasers of admission tickets oblige themselves to include the following business relations into their customer agreements.
2. Rules for the events of the Gewandhaus zu Leipzig
2.1 Ticket prices and reductions
2.1.1 Ticket prices
The Gewandhaus zu Leipzig publishes its valid admission prices in its publications and announces them at the ticket desk of the Gewandhaus zu Leipzig. There are various prices in various price categories. The Gewandhaus zu Leipzig allots them to each price group. The Gewandhaus zu Leipzig does not charge any advance sales fees. There might be higher admission prices at external advance sale offices when the supplier charges an advance sales fee and other fees defined by the supplier.
Reductions shall be published in the service section of the annual review. Reduction entitlements have to be asserted before purchasing tickets. Any subsequent reduction in the ticket price shall be ruled out. Said reduction entitlement shall be shown at admission without solicitation.
2.2 Sales of admission tickets
2.2.1 Written ticket reservations
From the time each annual review is published, the Gewandhaus zu Leipzig receives written requests for reservations (by letter/fax/email). The requests received shall be processed chronologically. The customer will receive a written confirmation of reservation stating the seats reserved, the order value, the period of reservation and the bank details of the Gewandhaus. The order shall be firmly booked when the money is received within the period of reservation. It shall be sent by post or when the customer picks up the ticket. The reservation shall expire if the payment cannot be booked within the period of the given reservation. If it is not possible to fulfil ticket requests since seats are not available, the customer shall receive an offer of alternative seats. If this is not desired or not possible, these requests will be put on a waiting list and served if seats are available later.
2.2.2 Advance sales
Advance sale shall begin at the ticket desk of the Gewandhaus zu Leipzig, in its webshop, at its call center and at advance sales offices on the day scheduled for it and for the entire season. Individual events may already be sold out at the beginning of advance sales due to written pre-booking and subscriptions. If substantial demand is anticipated, the sales of a certain number of tickets may be limited for an event or a series of events. The date when advance sales start and events with separate advance sales conditions will be published in the service section of the annual review.
2.3 Loss of tickets
The Gewandhaus zu Leipzig cannot reimburse the purchase price if admission tickets are lost. To the extent that the customer can document or substantiate by prima facie evidence what event and what seats the customer purchased, the Gewandhaus zu Leipzig can issue substitute tickets and they shall be designated as substitute tickets. If both the original ticket and a substitute ticket are submitted for the same seat, the owner of the original ticket shall have priority. The owner of the substitute ticket shall not have any claim to another seat being allotted if his or her seat is claimed by the owner of the original ticket.
2.4 Exchange and return
Admission tickets shall be excluded from exchange and return unless the concert is cancelled or there is an essential change in the programme or casts. Any claim to reimbursement shall be asserted within 6 weeks after the scheduled end of the event by submitting or returning the tickets that have not been invalidated to the extent that said admission tickets were purchased from the Gewandhaus zu Leipzig. If said admission tickets were purchased from an external advance sales office, the claim for reimbursement shall be asserted there.
2.5 Terms and conditions of subscription
The terms and conditions of subscription shall extend as a supplement to the subscriptions of the Gewandhaus zu Leipzig.
3 Regulations for external/leased events in the Gewandhaus zu Leipzig
3.1 The subject matter of the agreement
In the absence of any other statements, the Gewandhaus zu Leipzig itself is not the promoter of the events offered. The Gewandhaus zu Leipzig sells admission tickets on behalf of or in the name of and on the account of each promoter. Contractual relations materialise exclusively between the purchaser and promoter with reference to attending the event by purchasing admission tickets. The general terms and conditions of each promoter might apply to said legal relations.
3.2 Ticket prices
The Gewandhaus zu Leipzig publishes the valid admission prices in its publications and it announces them at the ticket desk of the Gewandhaus zu Leipzig. There are various prices in various price categories. The concert promoter allots them to each of the price categories. There are additional advance sales and other fees in the ticket price at advance sales.
The reductions set by the promoter shall apply. They are announced in the publications. Any reduction entitlements have to be asserted before ticket sales. Any subsequent reduction in the ticket price shall be ruled out. Said reduction entitlement shall be shown at admission without solicitation.
3.4 Selling admission tickets
Tickets can be booked locally at the ticket desk of the Gewandhaus zu Leipzig at the beginning of advance sales by phone through the call center and the webshop of the Gewandhaus zu Leipzig. The decision to also sell admission tickets via other advance sales offices and ticket suppliers is incumbent upon the promoter. Any exclusive advance sales starts (such as PreSales) at selected advance sales offices shall be reserved to the promoter.
3.5 Loss of tickets
The regulations for lost admission tickets shall be dictated by the general terms and conditions of each concert promoter or the statutory regulations.
3.6 Exchange and return
The regulations for exchanging and returning admission tickets shall be dictated by the general terms and conditions of each concert promoter or the statutory regulations.
The purchase of an admission ticket for a leased event shall exclusively constitute a legal relationship between the ticket purchaser and promoter with reference to the event. The Gewandhaus zu Leipzig shall not assume any liability for meeting the promoter’s performance obligations and it shall not bear the risk of the promoter’s insolvency. The customer can only assert claims from non-performance or legally insufficient performance (faulty performance) against the promoter.
4.1Resale of tickets
Only non-commercial resale of admission tickets by customers as defined under section 1 (I) is permitted. Any sales to commercial users or for commercial use shall not be allowed. The price printed on the admission tickets may not be exceeded, nor may any surcharges or other fees be added. Reselling admission tickets at auctions is particularly forbidden. Commercial resale by customers as defined under section 1 (II) is permitted.
If these rules are violated, the Gewandhaus zu Leipzig shall have the right
a) to block affected customers from buying additional tickets for a reasonable period of time;
b) to demand payment from the customer in the amount of the excess proceeds or profit gained from resale. Offering to sell admission tickets inside the Gewandhaus zu Leipzig is not permitted. The Gewandhaus zu Leipzig shall not be liable for the performance of third parties.
The Gewandhaus zu Leipzig sells coupons that can be used for paying the admission tickets of the Gewandhaus zu Leipzig and third parties (leased events) in the Gewandhaus zu Leipzig. They shall be valid for three years to the end of each year. A (partial) payout of coupons shall not be possible. Any residual values when redeeming the coupon shall be refunded in the form of a new coupon on the existing residual value.
4.3 Programmes and starting times
The programmes and starting times of events shall be announced in the publications of the Gewandhaus zu Leipzig. We reserve ourselves the right to make changes. Persons attending can be admitted to the auditorium after the beginning of an event at a point in time that is suitable for artistic reasons taking consideration of the course of the concert, although there is no longer a claim to the previously purchased seat. There shall not be a legal claim to substantial admission.
To ensure public safety at events, the contents of bags, containers and clothing, such as coats, jackets and capes, may be searched by Gewandhaus staff or a third party authorized by it.
All objects, substances and materials which could endanger the safety of the public or interfere with the event may not be brought into the Gewandhaus. Visitors who do not wish to consent to these security checks or to the confiscation of any objects that could endanger the event will not be admitted to the event. Visitors who have been turned away shall have no claim to repayment of the admission price or any other damage compensation.
Visitors who are in possession of a valid admission ticket may handover their coats and other personal belongings to the service personnel of the Gewandhaus zu Leipzig for safekeeping during the event at no extra charge. No animals or dangerous or illegal objects will be accepted. Any coats, jackets, bulky objects (umbrellas, backpacks, canes with the exception of walkers, and large bags) may not be taken into the concert halls and must be handed over for safekeeping. Visitors will be given numbered tokens. Upon presentation of the token, the service personnel will return the corresponding items. The items handed over for safekeeping (including any scarves, gloves and glasses, umbrellas, canes, purses and similar bags and their contents) are insured against loss or damage for up to 2,500 EUR. Objects which are not insured include valuables, jewelry, other objects made of precious metals, cash and other financial instruments, business papers, documents of all kinds, public transport tickets and keys. Details regarding the cloakroom’s policies regarding refusal of service and the duties and obligations of persons using the cloakroom can be found on the information sheets posted near the cloakroom. Items that have been mixed up, damaged or are missing must be reported immediately to the service personnel. A fee of 3.50 EUR will be charged for each lost token. This fee must be paid in cash before the personal belongings will be returned; furthermore, the personal belongings will only be returned to the visitor after all other checked items have been returned to their rightful owners.
4.6 Image and sound recordings
All image and/or sound recordings including photographing during the events are prohibited. This also extends to recordings exclusively for private use. Any unauthorised recording can trigger the obligation of compensation for damage. If this is not complied with, the Gewandhaus zu Leipzig reserves itself the right to confiscate and store recording devices until the owner has consented to the recording being deleted. The Gewandhaus zu Leipzig shall be liable for confiscated and stored objects to the extent that damage was caused intentionally or with gross negligence. The Gewandhaus zu Leipzig expressly points out that the Gewandhaus zu Leipzig can produce image and/or sound recordings (photographs/video/audio recordings) in specific events. The Gewandhaus zu Leipzig shall be entitled to use said recordings for advertising purposes on its own website, posters, brochures, flyers, other online and offline advertising and communication channels and in its media reporting, in particular to duplicate, disseminate, publicly reproduce or make them publicly available. When admission tickets are purchased and the event is attended, the person attending declares that he or she agrees that he or she might be recorded and that said recording can be used as described without any claim to remuneration to the extent that the justified interests of the person attending are not to the contrary.
The Gewandhaus zu Leipzig shall be liable if there is violation for injury to life, limb and/or health. For other injuries, the Gewandhaus zu Leipzig shall be liable with an intentional or grossly negligent violation of neglect of duty. If other injuries are based on a simple negligent violation of a cardinal obligation (i.e., an obligation in the mutuality of obligation whose compliance the customer may trust in and that even make it possible to carry out the agreement), the Gewandhaus zu Leipzig shall be liable to the amount the predictable injury typical for contracts. Said liability provisions shall also extend to the liability of the legal representatives and vicarious agents of the Gewandhaus zu Leipzig.
4.8 Power of the keys
The personnel of the Gewandhaus zu Leipzig shall be entitled to remove persons from occurring events if they constitute a considerable annoyance, in particular with a violation of the prohibition of making image and/or sound recordings or annoying another person attending. Beyond this, persons who are in the Gewandhaus zu Leipzig may be removed from all of the premises if their behaviour is improper, in particular with illicit behaviour or when another person is annoyed by them.
By ordering or reserving tickets customers indicate their consent to the collection, processing, storage and use of the customer’s personal information by the Gewandhaus zu Leipzig in compliance with data protection law as is necessary to initiate and fulfill the contract. The Gewandhaus zu Leipzig has the right to share this data with natural or legal persons if said persons have been commissioned by the Gewandhaus to conduct ticket sales.
5 Power of revocation
If you are a consumer (i.e., a natural person who passes on the order for a purpose that can neither be attributed to your commercial nor independent professional activities), you shall be entitled to a power of revocation pursuant to the specifications of the statutory regulations. There is a power of revocation with purchasing agreements for goods (such as coupons) that were concluded pursuant to the Fernabsatzgesetz - Distance Selling Act, i.e. by phone or online. Said right shall not exist with contracts whose object are services in leisure time and where a fixed date is envisioned for providing the services (such as admission tickets).
5.1 Advice on revocation
You have the right to revoke a purchase agreement that was concluded pursuant to the Fernabsatzgesetz (by phone or online) within 14 days without giving reasons. Said period of revocation shall be 14 days from the day when you or a third party specified by you who is not the carrier have or has occupied the goods. To exercise your power of revocation, you have to notify the supplier (i.e., the Gewandhaus zu Leipzig) on your decision to revoke said agreement by means of an unambiguous declaration (for instance, a fax, email, phone call or a letter sent by post). If you make use of said possibility, we will send you confirmation of the receipt of said revocation to you without delay (for instance, by email). To exercise your power of revocation, it shall be sufficient to send the communication on exercising said power of revocation before the period of revocation expires.

5.2 The consequences of revocation
If you revoke the purchasing agreement, we have to repay all payments to you that we have received from you including delivery costs (with the exception of the additional costs that result when you have selected a type of delivery that differs from the low-priced standard delivery offered by us) without delay and no later than within 14 days from the day when we have received the communication on your revocation of this agreement. In the absence of any other explicit agreement with you for said repayment, we shall use the same means of payment you used with the original transaction; in any event, we will not charge you any remuneration due to this repayment. We may refuse repayment until we have received the goods again or until you have provided proof that you have returned the goods– whichever is earlier. You have to return the goods to us without delay and in any event no later than within 14 days from the day when you notify us of the revocation of the agreement hereto. Said period shall be discharged if you send the goods before the period of 14 days expires.
You shall bear the immediate costs of the return shipment of the goods. You also have to answer for any loss in value of the goods if said loss in value is attributed to handling them in a way that is not necessary for checking the condition, properties and functioning of the goods.
6 Entry into force
Said general terms and conditions shall apply from 1 March 2018.
